The Construction Resolution Process™

Helping Homeowners Move from Construction Problems to Resolution

START WITH A CONVERSATION →

When construction problems arise, homeowners often focus on one question:

"How do I get this fixed?"

The answer is rarely as simple as obtaining a construction inspection or technical report.

Understanding the condition is only the first step.

A report may identify what is wrong. But homeowners are often left with another question:

“What do I do with this information?”

The Construction Resolution Process™ was developed to answer that question.

It provides a structured approach for investigating the problem, developing technically supported findings, organizing the evidence, communicating with the appropriate parties, and determining the most practical path toward resolution.

We don’t simply identify construction problems. We help clients determine what to do about them.

WHY WE CREATED THE CONSTRUCTION RESOLUTION PROCESS™

Construction problems can quickly become confusing.

Homeowners may receive different explanations from builders, contractors, inspectors, insurance companies, and other professionals. Repairs may be attempted without resolving the underlying cause. Documents accumulate. Warranty deadlines approach. And eventually, what began as a construction problem can become a dispute.

The missing piece is often not another opinion. It is a clear, technically supported path forward.

We developed the Construction Resolution Process™ to bring structure to that situation—helping clients understand the problem, organize the technical evidence, communicate effectively with the appropriate parties, and make informed decisions about what should happen next.

The objective is clarity, credible technical support, and a practical path toward resolution.

The Construction Resolution Process™ is not a legal process.

It is an independent technical process designed to investigate construction conditions, develop credible evidence, organize the technical facts, and help clients make informed decisions about the most appropriate path forward.

Whenever reasonably possible, our objective is to pursue a technically supported resolution before litigation becomes the primary strategy.

When legal counsel is necessary, the attorney leads the legal case while The Construction Forensics Group can continue supporting and coordinating the technical side of the matter.

The Seven Steps of the Construction Resolution Process™

A structured approach to helping homeowners understand construction conditions, organize technical evidence, and move toward an informed resolution.

Every construction matter is different. The conditions, history, available evidence, parties involved, and potential paths toward resolution will vary from project to project.

The Construction Resolution Process™ provides a structured framework for moving from an identified concern through investigation, technical analysis, evidence development, engagement, strategy, and ultimately resolution.

Not every matter requires every step in exactly the same way. The process adapts to what the facts and circumstances require.

Construction Problem

Every resolution begins with recognizing that something isn't right.

Most homeowners contact us after noticing changes in their home that don't seem normal. These may include water intrusion, structural cracking, uneven floors, roof leaks, foundation movement, drainage concerns, workmanship deficiencies, or repeated warranty repairs that fail to resolve the underlying issue.

At this stage, the objective is not to determine fault. The objective is to recognize the condition, preserve available information, and begin asking the right technical questions before assumptions are made or evidence is altered.

Every successful resolution begins with understanding the problem.

Independent Investigation

Understanding what is happening requires an objective evaluation.

Once a concern has been identified, the next step is to independently evaluate the observed conditions. This may include a comprehensive site inspection, review of construction documents, photographs, warranty records, repair history, building codes, manufacturer requirements, and accepted construction practices.

Our role is to provide an unbiased technical assessment based on facts—not assumptions, opinions, or speculation.

An independent investigation establishes the foundation for every step that follows.

Technical Analysis

Information becomes meaningful through careful technical evaluation.

Construction defects rarely exist in isolation. Individual observations often reveal broader patterns involving design, workmanship, materials, sequencing, moisture management, structural performance, or building science.

During this stage, we evaluate the available information, identify relationships between observed conditions, and determine how the evidence supports the technical conclusions.

The goal is to understand not only what happened—but why it happened.

Evidence Development

Technical findings must be organized into clear, credible documentation.

The value of an investigation depends upon how effectively the findings are documented and communicated.

This stage includes organizing photographs, construction records, technical observations, supporting documentation, timelines, and professional reports into a clear and understandable presentation.

Well-organized documentation helps homeowners, builders, insurance carriers, attorneys, and other professionals understand the technical issues and the evidence supporting the conclusions.

Builder Engagement

Technical information is most valuable when it supports productive communication.

Many construction issues can be addressed through professional communication with builders, developers, contractors, warranty departments, insurers, or other responsible parties.

Our objective is to help homeowners present technically supported information in a clear, organized, and professional manner that encourages informed discussions and constructive problem-solving.

Every situation is different, and the appropriate path forward depends upon the circumstances of each project.

Resolution Strategy

Every project requires a thoughtful path forward.

No two construction matters are exactly alike. Some situations may be resolved through warranty repairs or builder cooperation. Others may involve additional technical evaluations, insurance claims, mediation, arbitration, or litigation support.

During this stage, we help homeowners understand the available options, evaluate the technical considerations, and determine the most appropriate strategy based on the facts of their particular situation.

Our role is to provide independent technical guidance that supports informed decision-making.

Successful Resolution

The goal is not simply to produce a report. The goal is to help homeowners move forward.

A successful resolution looks different for every homeowner. It may involve corrective construction, warranty repairs, negotiated settlements, insurance coverage, expert support, or other technically supported outcomes.

Our objective is to pursue every reasonable opportunity for a technically supported resolution before litigation becomes the primary driver of the dispute.

When homeowners understand their construction conditions, have credible technical documentation, and follow a structured process, they are better positioned to make informed decisions and pursue meaningful solutions.

Understanding the problem is the first step.

A structured process is what helps move homeowners toward resolution.

Possible Paths to Resolution

There is no single outcome that defines a successful construction resolution.

Depending on the condition, responsibility, available evidence, warranty status, insurance involvement, and the parties involved, the appropriate path may take several different forms.

The objective is not to force every matter toward the same outcome. It is to determine which path is most appropriate based on the facts.

Who This Process Is Designed For

The Construction Resolution Process™ is designed for situations where a construction problem needs more than another opinion or isolated repair recommendation.

It may be appropriate when:

  • A construction problem is recurring, progressive, or not fully understood
  • A builder or contractor has attempted repairs, but the problem continues
  • There are conflicting opinions about the cause or responsibility
  • A warranty claim is delayed, disputed, or approaching an important deadline
  • Water intrusion, structural movement, mold, moisture, or other conditions may involve a larger underlying problem
  • Technical evidence needs to be organized and presented clearly to a builder, contractor, insurer, HOA, or other responsible party
  • The matter is becoming more complicated and may eventually require engineers, specialists, attorneys, mediation, arbitration, or litigation

The process can be adapted to the complexity of the matter. Not every construction problem requires every stage.

When Should You Contact Us?

You do not need to wait until a construction problem becomes a major dispute.

In many situations, earlier involvement gives us more opportunity to understand the condition, preserve important documentation, and help address the problem before positions become entrenched.

Consider contacting us when:

  • You see something concerning during construction or before closing
  • A builder tells you a condition is “normal,” but you remain concerned
  • A warranty issue is not being addressed or important deadlines are approaching
  • Repairs have been attempted, but the problem keeps returning
  • Cracking, movement, water intrusion, moisture, mold, or other conditions appear to be getting worse
  • Different contractors, inspectors, or experts are giving you conflicting explanations
  • You are considering hiring an attorney but do not yet have a clear technical understanding of the problem
  • The amount of documentation, experts, communications, or disputed issues is becoming difficult to manage

The earlier the facts are understood and documented, the more options you may have for moving the matter toward resolution.

When the Process Becomes More Complex

Some construction matters become too complicated to manage through individual inspections, reports, repairs, and communications alone.

Multiple defects may be involved. Experts may need to be coordinated. Evidence and correspondence can accumulate quickly. Responsibility may be disputed. Insurance, mediation, arbitration, or litigation may become part of the matter.

When that happens, the technical side of the case needs coordination.

Through Construction Case Management, The Construction Forensics Group can help organize the investigation, evidence, experts, builder or contractor engagement, and technical resolution strategy as the matter develops.

When legal counsel becomes involved, the attorney leads the legal case while CFG continues coordinating and supporting the technical side.

Complex construction problems require more than information. They require coordination.
