THE CONSTRUCTION DISPUTE FILES

Real Cases. Different Paths. Real Outcomes.

What actually happens after a serious construction problem becomes a dispute?

The Construction Dispute Files follows real construction cases over time—from the first signs of trouble through investigation, builder response, negotiation, litigation when it occurs, and ultimately resolution.

These aren't hypothetical case studies. We're following what happens next.

EXPLORE THE CASES →

A DIFFERENT KIND OF CONSTRUCTION STORY

Most Construction Stories Are Snapshots.

Most construction stories capture a moment.

A homeowner discovers mold. A foundation cracks. A roof leaks. A builder refuses a repair. Someone hires an attorney.

Then the story disappears.

But that's often when the real story begins.

Construction disputes can continue for months or years. Engineers become involved. Attorneys may be retained. Experts disagree. Repairs are proposed or rejected. Settlement discussions begin. Costs accumulate.

And through all of it, someone still owns the house.

The Construction Dispute Files follows selected cases beyond the initial complaint to document what actually happens next.

DIFFERENT CASES. DIFFERENT PATHS.

There Is No Single Path Through a Construction Dispute.

Every construction dispute develops differently. The facts, the evidence, the builder's response and the decisions made along the way can send similar problems in very different directions.

Some Go Legal

Some Pursue Resolution

Some Pursue Resolution

Some homeowners decide that litigation, arbitration or formal legal representation is the appropriate path forward.

We follow what happens after that decision—including the process, the time involved and the eventual outcome.

Some Pursue Resolution

Some Pursue Resolution

Some Pursue Resolution

Others attempt to resolve construction problems through investigation, documentation, technical analysis, warranty processes and direct builder engagement.

We follow those cases too.

Some Change Course

Some Pursue Resolution

Some Change Course

A case may begin cooperatively and eventually require an attorney. Another may begin headed toward litigation but ultimately resolve through negotiation.

The path can change as the evidence and circumstances develop.

There is no predetermined ending.

WHAT WE FOLLOW

Every Case Has a Story. We Follow It From Problem to Outcome.

Each Construction Dispute File follows the same basic framework, allowing readers to see not just what went wrong, but what happened afterward.

THE PROBLEM

THE EVIDENCE

THE EVIDENCE

What happened to the home?

The defect, damage, failure or condition that started the dispute.

THE EVIDENCE

THE EVIDENCE

THE EVIDENCE

What does the evidence establish?

Inspections, testing, photographs, construction documents, correspondence and expert findings.

THE RESPONSE

THE EVIDENCE

THE RESPONSE

How do the other parties respond?

Builder, contractor, insurer, HOA or other involved parties—and what they agree or disagree about.

THE DECISION

THE DECISION

THE RESPONSE

What path does the homeowner choose?

Direct resolution, warranty process, negotiation, arbitration, litigation—or another approach.

THE PROCESS

THE DECISION

THE PROCESS

What happens next?

We follow the case as it develops over the following weeks, months or, when necessary, years.

THE OUTCOME

THE DECISION

THE PROCESS

How does it end?

Repairs, settlement, litigation, arbitration, buyback, unresolved dispute—or another result.

We don't write the ending before the story begins. We follow the case.

FEATURED CASE • CASE FILE 004

The House They Couldn't Live In

A newly constructed home. Serious moisture and mold concerns within weeks. Less than a year later, the homeowners are no longer living there.

FEATURED CASE • CASE FILE 004

Shortly after moving into their newly constructed Pulte home, the homeowners began experiencing concerns involving moisture and mold.

The problems escalated. Testing, investigation and remediation followed. Additional construction concerns emerged, and eventually the homeowners stopped living in the house.

The Construction Forensics Group became involved to evaluate the circumstances and discuss potential paths toward resolution.

Our approach generally emphasizes investigation, documentation, technical analysis and direct engagement before litigation when the circumstances allow.

In this case, the homeowners ultimately decided to pursue a legal strategy instead.

Their story isn't over.

We're following what happens next.

FOLLOW THE FILES

These Stories Continue After the First Article.

The Construction Dispute Files follows selected cases as they develop. Some are still unfolding. Others have reached resolution. Each file documents a different path through a construction dispute.

The case isn't finished until the story is.

ABOUT THE CONSTRUCTION DISPUTE FILES

Real Cases. Documented Over Time.

The Construction Dispute Files is an ongoing project of The Construction Forensics Group documenting how real construction disputes develop, the paths homeowners choose and what ultimately happens.

These stories are based on actual cases and available documentation. Where a dispute remains active, allegations, technical findings, builder responses and established facts are distinguished whenever appropriate. Identifying information may be withheld to protect the privacy of the people involved.

When The Construction Forensics Group has been involved in a featured matter, our role will be disclosed.

We don't predict the ending. We document what happens.
